By using the services of the website www.apartmani-vrsi.com (Website), you declare that you are familiar with the General Advertising Terms on the website www.apartmani-vrsi.com and agree to them.
The General Terms represent a set of rules that define the relationship between the Website Owner (and authorized representatives, site administrators), Advertisers (Advertising Clients), and Users of Advertisers’ services. Advertisers may advertise tourist accommodation facilities and/or products and services related to the industry.
Accuracy and Truthfulness of Advertisement Data
The Advertiser is the owner of the advertised accommodation facility and, as such, possesses all necessary documentation for renting out tourist accommodation or is an authorized representative of the service provider. Besides tourist accommodation, the Advertiser also promotes products and services related to industrial sectors on the Website.
The Advertiser is responsible for promoting their services and products in accordance with the applicable Consumer Protection Law. The Advertiser assumes full responsibility for the textual and visual information posted on the Website and guarantees its accuracy, completeness, truthfulness, quality, safety, and legality of the offered products and services.
The Advertiser agrees to modify the displayed textual and visual information via the administrative interface in case of changes in the advertised offer details. The Advertiser is obligated to regularly update the availability calendar and transparently display accommodation prices.
The Advertiser agrees to accept invoices in electronic form, in accordance with Article 80 of the Value Added Tax Act and Article 161 of the Value Added Tax Regulation, issued by xxxxxxxx d.o.o.
Privacy Protection and Use of Personal Data
Your privacy is important to us, and we never misuse the data you voluntarily submit on the Website. The Website Owner commits to respecting anonymity and privacy on the Website, to the extent permitted by the nature of our relationship and business.
Advertisers and users of the Website’s services agree that the Website Owner collects personal data, including:
- Full name
- Address
- Phone number
- Email address
- Personal Identification Number (OIB)
Other data:
- Profile photos
- Photos of accommodation facilities
- Additional profile information (gender, language skills, other skills)
- Additional information about services and products
In accordance with the Law on the Prohibition and Prevention of Unregistered Activities (Official Gazette 6/11), Article 7, Paragraph (2):
"The Advertiser is required to provide identification details when ordering an advertisement, including company name and headquarters, OIB, full name of the responsible person or the advertiser's full name, OIB, and their residence or domicile."
According to Paragraph (3) of the same Law, which states:
"It is prohibited to publish advertisements if the advertiser does not provide the data specified in Paragraph 2 of this Article,"
the Website Owner is obligated to collect the submitted data. These data will be stored and processed in accordance with the General Data Protection Regulation (GDPR EU 2016/679 of the European Parliament and Council, dated April 27, 2016), as follows:
- Personal data are required to enable Advertisers and Users to use the Website’s services.
- We will store them and use them for promoting Advertisers' services and products.
- Apart from advertising, personal data will be used for processing accounting documentation in accordance with the provisions of the Accounting Act, the Corporate Income Tax Act, the Value Added Tax Act, and other legal regulations governing the business operations of legal entities.
- When paying for the services of the Website Owner, the data controller for payment information requires certain financial details (such as bank account or credit card information) to process payments and comply with applicable laws. These details will be used exclusively for these purposes.
Personal data may be provided to relevant state inspection authorities (Article 8 of the Law on the Prohibition and Prevention of Unregistered Activities (Official Gazette 6/11)). Advertisers' personal data will be provided to competent authorities only upon their official request, and such disclosure does not require the Advertiser's consent, in accordance with Paragraph (4), Article 7 of the same Law:
"The advertising organization is required to provide the competent authorities referred to in Article 8 of this Law, upon their request, with information about the advertiser as prescribed in Paragraph 2 of this Article."
The email address of the Advertiser and User may be used to notify them about services, promotions, changes in the General Advertising Terms on the website www.apartmani-vrsi.com, and other business rules of the Website.
The Advertiser and User may at any time request to stop receiving service and promotional notifications from the Website.
In addition to personal data, the Advertiser may provide additional information to better present their services on the Website, such as personal interests, gender, skills (languages spoken), or additional features of their offer. The Advertiser agrees that such information is public and visible to everyone, and the Website Owner has no right to copy, process, or store this information.
Apart from the aforementioned data, the Advertiser and User may provide information in other ways, such as by filling out forms, conducting searches, updating profiles, responding to surveys, participating in promotions, or using special offers on the Website. These collected data are anonymous, and the Website Owner commits to using them solely for this purpose and not disclosing them to third parties.
User comments (ratings, reviews) about Advertisers' services will be published on the Website and do not require the Advertiser's consent. The Website Owner does not control and is not responsible for information provided by Users, which may contain details about the Advertiser.
If an Advertiser requests the removal of inaccurate user comments, the Website Owner may ask for additional information from the Advertiser and User, which will be used solely to verify the validity of the request.
Personal data provided through the Website or interactive data collection forms (private inquiry, registration, etc.) will be used solely in accordance with the GDPR EU 2016/679 of the European Parliament and Council.
At any time, you can request information about how your personal data is stored, used, and distributed by the Website Owner. The deadline for providing the requested information is 15 days from the date of request submission. Requests can be submitted in writing or via email.
Additionally, at any time, you may request changes or complete deletion of all your personal and other data.
Your collected personal data will not be used for purposes other than those previously mentioned. They will not be misused, subjected to secret processing, sold to third parties, or distributed to unauthorized persons, except with the Advertiser's and User's written consent.
Your personal data is recorded in written and electronic form and is stored on the premises of the Website Owner. The collected data is available to the Website Owner, the Website Administrator and the Website Accountant. All other individuals do not have access to your personal data. The retention period for business documents containing your personal data is 11 years. After this period, your personal data will be destroyed.
We will not treat other communications or materials you send us, such as compliments, comments, suggestions, etc., as confidential and as if we could not use them freely.
Administrative function
The Website Administrator makes the necessary corrections, changes or removal of published data if necessary, and this may be in the following cases:
when the information about the property or advertiser is incomplete, when the property already present in the catalog is entered multiple times, when the advertisement is placed in the wrong category, when the description and/or price in the advertisement are incorrect and/or incomplete, when the text or images in the advertisement and/or the advertiser violate copyright or other intellectual property rights, when the advertisement with text or images may cause damage and/or in any way violate the intellectual rights of others, when the advertisement with text or images contains discriminatory, contrary to public morality and/or prohibited and unauthorized materials against Croatian law, when the advertisement contains photographs with watermarks of third parties, when the advertisement contains a collage of photographs (photographs composed of multiple photographs), when the advertisement contains multiple products or services for which no fee has been paid, when the advertisement in any way insults the Website, when the advertisement tries to promote a competing company directly or indirectly, without prior agreement with the owner and Owner of the Website, when the ad is suspicious regarding the advertising of illegal services and/or accommodation, when the ad violates the quality of the rest of the content of the Website in any way.
Right of Exclusion
The owner of the website reserves the right to exclude the user who in any way violates the General terms of advertising on the Apartmanija.hr website, interferes with the operation of the website in any way or violates the rights of the Advertiser and the User in any way. This is especially true for Users who abuse the published data or use the content of the website without authorization, especially in terms of copying content published on Apartmanija.hr and publishing it on other advertising media, lobbying for Advertisers to advertise on similar sites or other advertising media by contacting them in any way and offering their services.
In this case, the Website Owner, after excluding such a User, may request compensation for damages or lost profits.
